Welcome to D-Legacy Basketball Academy (“D-Legacy,” “we,” “our,” or “us”).

These Terms of Service (“Terms”) govern your use of the D-Legacy Basketball Academy website, registration services, basketball programs, camps, clinics, training sessions, events, and other services offered by D-Legacy.

By accessing our website, submitting a registration form, purchasing or enrolling in a program, or participating in any D-Legacy activity, you agree to these Terms.

If you are registering or acting on behalf of a participant who is under 18 years old, you represent that you are the participant's parent or legal guardian and have the authority to accept these Terms on the participant's behalf.

If you do not agree with these Terms, please do not use our website or participate in our programs.


1. ABOUT D-LEGACY BASKETBALL ACADEMY

D-Legacy Basketball Academy is a basketball development organization focused on helping players improve their basketball skills, physical abilities, basketball knowledge, discipline, confidence, character, teamwork, and overall development.

Our programs may include, but are not limited to:

  • Basketball training

  • Beginner-level programs

  • Intermediate-level programs

  • Advanced-level programs

  • Basketball camps

  • Basketball clinics

  • Skills development sessions

  • Group training

  • Individual development activities

  • Basketball events

  • Community activities

  • Player development programs

Program schedules, locations, coaches, activities, and offerings may change from time to time.


2. ELIGIBILITY AND REGISTRATION

Participants must provide accurate and complete information when registering for a D-Legacy program or activity.

Information provided during registration may include:

  • Participant's name

  • Age

  • Parent or guardian information

  • Emergency contact information

  • Contact details

  • Program selection

  • Other information reasonably necessary for participation

D-Legacy reserves the right to refuse, suspend, or cancel a registration when:

  • The information provided is false or misleading;

  • Registration requirements have not been completed;

  • Required parental or guardian authorization has not been provided;

  • Payment requirements have not been satisfied;

  • The participant engages in serious misconduct; or

  • Participation may create a safety or operational concern.


3. PARTICIPANTS UNDER 18

Participants under 18 years old must have the involvement and authorization of a parent or legal guardian where required by D-Legacy.

By registering a minor, the parent or legal guardian confirms that:

  • They have the legal authority to register the participant;

  • The information provided is accurate;

  • They understand the nature of basketball training and physical activities;

  • They have reviewed the applicable rules and policies;

  • They understand the risks associated with participation;

  • They will communicate relevant safety or medical information to D-Legacy where reasonably necessary; and

  • They authorize the minor to participate in the applicable D-Legacy program, subject to any separate waiver or consent requirements.

D-Legacy may require a parent or legal guardian to accompany or remain responsible for a minor participant when required by the program, venue, or circumstances.


4. PROGRAMS AND SCHEDULES

D-Legacy makes reasonable efforts to provide accurate information regarding its programs, schedules, locations, prices, coaches, and activities.

However, schedules and program details may change because of circumstances including:

  • Weather conditions

  • Facility availability

  • Coach availability

  • Holidays

  • Safety concerns

  • Community or venue requirements

  • Operational circumstances

  • Events beyond our reasonable control

D-Legacy reserves the right to modify, reschedule, relocate, suspend, or cancel a session when reasonably necessary.

When reasonably possible, D-Legacy will provide participants or parents/guardians with notice of significant changes.


5. FEES AND PAYMENT

Program fees and other applicable charges will be displayed during the registration or purchasing process.

By completing a purchase or registration, you agree to pay the applicable fees.

Unless otherwise stated:

  • Fees must be paid according to the payment instructions provided by D-Legacy.

  • A registration may not be considered confirmed until required payment and registration requirements have been completed.

  • D-Legacy may limit the number of participants in a program.

  • Available slots may be assigned on a first-come, first-served basis or according to the registration process specified for the particular program.

D-Legacy reserves the right to correct pricing or other information errors discovered on the website.


6. CANCELLATION, REFUND, AND RESCHEDULING

Because D-Legacy programs involve limited participant slots, facility reservations, coaches, equipment, and other operational expenses, cancellation and refund requests may be subject to the specific refund policy applicable to the program.

Before completing payment, participants and parents/guardians should review the applicable cancellation and refund terms.

If D-Legacy cancels a program or session, we may, depending on the circumstances:

  • Reschedule the session;

  • Offer a replacement session;

  • Provide a credit;

  • Offer a refund where applicable; or

  • Provide another reasonable alternative.

Refunds are not automatically guaranteed for missed sessions, late arrivals, voluntary withdrawal, or failure to attend unless otherwise stated in the applicable program policy.


7. MISSED CLASSES AND ATTENDANCE

Participants are responsible for attending their scheduled training sessions.

If a participant cannot attend a scheduled session, the participant or parent/guardian should notify D-Legacy as soon as reasonably possible.

Unless otherwise stated in the applicable program terms:

  • Missed classes may not be refundable.

  • Make-up sessions are not guaranteed.

  • D-Legacy may limit the number or availability of make-up sessions.

  • Late arrival does not automatically extend the participant's training time.


8. BASKETBALL ACTIVITIES AND INHERENT RISKS

Basketball is a physical sport and participation involves inherent risks.

These risks may include, but are not limited to:

  • Muscle strains

  • Sprains

  • Bruises

  • Falls

  • Collisions

  • Cuts or abrasions

  • Fractures

  • Concussions

  • Heat-related illness

  • Physical exhaustion

  • Other accidental injuries

Participants are expected to follow instructions from coaches and staff and to participate within their individual physical abilities.

By participating in D-Legacy activities, participants and their parents or legal guardians acknowledge that basketball involves inherent physical risks.


9. HEALTH AND SAFETY

Participants and their parents or guardians are responsible for informing D-Legacy of relevant health, physical, allergy, or safety information that may reasonably affect participation.

Participants should not participate when they are experiencing an illness, injury, or other condition that makes physical activity unsafe.

D-Legacy may restrict or stop a participant's participation when a coach or staff member reasonably believes that continued participation may pose a safety risk.

In an emergency, D-Legacy may contact the participant's emergency contact and/or seek appropriate emergency assistance.


10. COACHING AND PLAYER DEVELOPMENT

D-Legacy's coaches and trainers provide basketball instruction and development based on their experience, training methodology, and assessment of the participant.

However, D-Legacy does not guarantee:

  • A specific skill improvement;

  • Selection for a team;

  • Tournament participation;

  • Scholarships;

  • Professional contracts;

  • Collegiate opportunities;

  • Recruitment opportunities;

  • Employment;

  • Professional basketball opportunities; or

  • Any specific athletic outcome.

Player development depends on numerous factors, including effort, attendance, physical development, attitude, consistency, coaching, competition, and individual circumstances.


11. PARTICIPANT CONDUCT

D-Legacy expects all players, parents, guardians, coaches, staff, and visitors to maintain a respectful and safe environment.

Participants must:

  • Follow reasonable instructions from coaches and staff;

  • Treat other participants respectfully;

  • Respect coaches, staff, parents, guardians, officials, and facility personnel;

  • Use basketball equipment and facilities responsibly;

  • Avoid fighting or threatening behavior;

  • Avoid bullying, harassment, discrimination, or intimidation;

  • Avoid abusive, offensive, or inappropriate language;

  • Avoid damaging property;

  • Follow facility rules;

  • Follow applicable safety requirements; and

  • Behave in a manner consistent with a positive basketball community.

Serious or repeated violations may result in suspension or removal from a D-Legacy activity.


12. PARENT AND GUARDIAN CONDUCT

Parents and guardians are expected to support a positive and respectful environment.

Parents and guardians must not:

  • Threaten or harass coaches, staff, players, or other parents;

  • Interfere with coaching activities;

  • Enter restricted areas without authorization;

  • Engage in abusive or inappropriate behavior;

  • Disrupt training sessions;

  • Damage facility property; or

  • Engage in behavior that creates a safety concern.

D-Legacy reserves the right to restrict access to activities or facilities when necessary to protect participants, staff, or the integrity of the program.


13. FACILITY RULES

Participants must comply with the rules of the basketball court, gym, school, community facility, or other venue used for D-Legacy activities.

D-Legacy is not responsible for personal belongings left unattended at a venue.

Participants should avoid bringing valuable or unnecessary items to training sessions.


14. PERSONAL BELONGINGS

Participants are responsible for their own belongings.

D-Legacy is not responsible for lost, stolen, damaged, or misplaced personal property unless otherwise required by applicable law.


15. PHOTOS, VIDEOS, AND MEDIA

D-Legacy may photograph or record basketball training sessions, games, camps, clinics, events, and community activities.

Subject to applicable consent requirements and our Privacy Policy, photographs and videos may be used for legitimate D-Legacy purposes, including:

  • Website content

  • Social media

  • Marketing

  • Promotional materials

  • Player success stories

  • Basketball highlights

  • Community announcements

  • Training-related content

Where a participant is a minor, D-Legacy may require appropriate authorization from a parent or legal guardian before using identifiable images or other personal information for promotional purposes.

Any separate photo/video consent or release provided by D-Legacy will apply according to its own terms.


16. INTELLECTUAL PROPERTY

All content appearing on the D-Legacy website and official materials, including where applicable:

  • Logos

  • Brand names

  • Graphics

  • Photographs

  • Videos

  • Written content

  • Designs

  • Training materials

  • Website layouts

  • Promotional materials

is owned by or used with permission by D-Legacy or its respective rights holders.

You may not copy, reproduce, modify, distribute, sell, publish, or commercially exploit D-Legacy materials without prior written permission, except where permitted by applicable law.


17. USER-SUBMITTED CONTENT

If you submit photographs, videos, testimonials, reviews, comments, or other content to D-Legacy, you represent that:

  • You have the necessary rights or authorization to submit the content;

  • The content does not unlawfully infringe another person's rights;

  • The content does not contain unlawful or harmful material; and

  • You have obtained appropriate authorization from any identifiable individuals where required.

By submitting content for publication or promotional purposes, you grant D-Legacy permission to use the content for the purposes agreed upon or described at the time of submission, subject to applicable privacy and consent requirements.


18. WEBSITE USE

You agree to use the D-Legacy website only for lawful purposes.

You must not:

  • Attempt to gain unauthorized access to the website;

  • Introduce malicious software;

  • Interfere with website functionality;

  • Attempt to obtain another person's information without authorization;

D-Legacy makes reasonable efforts to provide accurate information on its website and in its program materials.

However, we do not guarantee that all website content will always be:

  • Accurate;

  • Error-free; or

  • Continuously available.

Program information, schedules, prices, coaches, locations, and other details may change without prior notice when reasonably necessary.


21. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, D-Legacy Basketball Academy, its owners, coaches, trainers, staff, representatives, and authorized personnel will not be responsible for losses, damages, or injuries arising from participation in basketball activities except to the extent such liability cannot lawfully be excluded or limited.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under Philippine law.

Participation in D-Legacy activities may also be subject to a separate Participant Waiver and Release, which may contain additional terms concerning risks, medical emergencies, and liability.


22. INDEMNIFICATION

To the extent permitted by applicable law, you agree to be responsible for claims, losses, damages, liabilities, or reasonable expenses arising from:

  • Your violation of these Terms;

  • Your unlawful use of the website;

  • Your intentional or negligent misconduct;

  • Your violation of another person's rights; or

  • Damage caused by you to D-Legacy property or facilities.

This provision does not apply to the extent that applicable law prohibits such responsibility.


23. PRIVACY

  • Serious misconduct;

  • Non-payment;

  • Fraudulent registration;

  • Safety concerns;

  • Damage to property; or

  • Other serious violations of these Terms.

Where appropriate, D-Legacy may provide notice before taking such action.


25. FORCE MAJEURE

D-Legacy will not be responsible for delays, cancellations, or interruptions caused by circumstances beyond our reasonable control.

These circumstances may include:

  • Severe weather;

  • Natural disasters;

  • Government restrictions;

  • Public emergencies;

  • Facility closures;

  • Power or utility interruptions;

  • Transportation disruptions;

  • Security concerns;

  • Labor disruptions;

  • Serious illness or injury affecting essential personnel; or

  • Other events beyond our reasonable control.

When reasonably possible, D-Legacy will attempt to provide an alternative arrangement.


26. CHANGES TO THESE TERMS

D-Legacy may update these Terms from time to time.

Updated Terms will be posted on this website with a revised “Last Updated” date.

Your continued use of the website or participation in D-Legacy programs after updated Terms become effective constitutes acceptance of the updated Terms, to the extent permitted by applicable law.


27. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.


28. GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of the Philippines, without prejudice to applicable mandatory legal provisions.

Any dispute arising from these Terms shall be subject to the appropriate courts or dispute-resolution mechanisms with proper jurisdiction under Philippine law.
